Yes, he's presumed innocent.  But the choice words allegedly used in this arrest is what's getting attention.

According to REPORTS, North Dakota Rep. Nico Rios made a bunch of homophobic remarks to officers who were arresting him.   The walkback Rep. Rios made is reported to have been a statement in solidarity with law enforcement.  

If you're arrested for DUI, it's probably better to remain silent than to call officers slurs.  But we've dealt with that too, and had excellent results.
