Tragic news this Memorial Day weekend. According to REPORTS, a pedestrian was struck and killed by a car. Police suspect that alcohol was involved; the driver refused to submit a chemical sample to measure blood alcohol conteent.
Most people don't know that you're not presumed innocent when you're trying to get a bond. Every defendant is presumed innocent, but that presumption only applies at trial. For bond purposes, a magistrate does not have to presume you're innocent and can hold you in jail pending further proceedings. That's apparently what's happening here as the driver is being held without bond.
DUIs are treated seriously in Virginia. Cases like these are the reasons why.
