Just recently a man was arrested for DUI causing the death of a 79 year old woman. Wavy.com covered the story. Their sources indicate that the driver was allegedly intoxicated, perhaps by marijuana. This is sometimes referred to as a DUID (driving under the influence of drugs).

One of the main reasons prosecutors in Virginia go hard on driving under the influence is because of cases like this. Of course, the suspect here is presumed innocent, but he's facing incredibly serious charges. Any DUI could lead to death or serious injury with the wrong set of circumstances, so even if your arrest did not involve a death you must know that the risk of a fatality can be what's in the back of some prosecutors and judges' mind when you go to court.
